By accessing and using YourGarden ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, then you may not access the Service.

Description of Service

YourGarden is a web-based garden planning application that allows users to create, manage, and analyze visual garden layouts using a grid-based system. The Service includes features for plant management, seasonal tracking, photo documentation, and performance analytics.

User Accounts

Account Creation

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must be at least 13 years old to create an account
• One person may not maintain more than one account

Account Responsibilities

• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account
• We reserve the right to suspend or terminate accounts that violate these Terms

Subscription Plans and Billing

Plan Types

• Free Plan: Limited to 5 gardens with basic features
• Standard Plan: $2/month for up to 100 gardens with advanced features
• Pro Plan: $5/month for up to 500 gardens with premium features

Billing Terms

• Subscription fees are billed monthly in advance
• All fees are non-refundable except as required by law
• We offer a 14-day free trial for paid plans
• You may cancel your subscription at any time
• Price changes will be communicated 30 days in advance

Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any laws
• Upload malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use automated tools to access the Service without permission
• Reverse engineer, decompile, or disassemble any part of the Service
• Share your account credentials with others
• Use the Service to store or transmit illegal content

User Content

Your Content

You retain ownership of all content you create or upload to YourGarden, including garden layouts, custom plants, photos, and notes. By using our Service, you grant us a limited license to store, process, and display your content as necessary to provide the Service.

Content Standards

• Content must not violate any laws or third-party rights
• Content must not contain harmful, offensive, or inappropriate material
• You are responsible for ensuring you have rights to any content you upload
• We reserve the right to remove content that violates these standards

Intellectual Property

The YourGarden application, including its design, functionality, and plant database, is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our Service without permission.

Service Availability

• We strive to maintain high service availability but cannot guarantee 100% uptime
• We may temporarily suspend the Service for maintenance or updates
• We reserve the right to modify or discontinue features with reasonable notice
• We are not liable for any downtime or service interruptions

Limitation of Liability

To the maximum extent permitted by law, YourGarden shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or relating to your use of the Service.

Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind. We disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

Termination

• You may terminate your account at any time through your account settings
• We may terminate or suspend your account for violations of these Terms
• Upon termination, your access to the Service will cease immediately
• We will delete your data within 30 days of account termination

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which YourGarden operates, without regard to conflict of law principles.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the new Terms.
